Director Zen Forum: User-generated comments, content, and submissions

You are solely responsible for your submissions to the Director Zen My Community Forum "Forum".

You agree that you shall not:

• Publish, upload, or otherwise distribute to the Forum any libelous, defamatory, obscene, abusive, pornographic, or otherwise illegal material.
• Threaten or verbally abuse otherusers of the Forum or send repetitive messages spamming the forum.
• Use the Forum to solicit funds or advertise goods or services.

You agree that you shall:

• Respect the rights of other users, including their privacy and intellectual property rights.
• Follow the Community Guidelines set out below, as updated from time to time, including the requirement not to post information that could identify a child, family, or staff member.

Community Guidelines

These Community Guidelines are part of these Terms. They apply to everything you post in the Forum, including posts, comments, replies, and attachments. Before you can view or post in the Forum, you will be asked to confirm that you have read and agree to them, and Director Zen keeps a record of that confirmation.

• Treat others with respect. Kindness, patience, and taking turns apply here as much as in your classrooms. Do not harass, threaten, bully, or demean anyone, including through remarks that target a person’s race, ethnicity, national origin, religion, beliefs, gender, sexual orientation, age, disability, or any other aspect of identity. Do not post sexually explicit material.
• No politics or social debates. Do not post political content or debate social issues, even when the topic relates to childcare. Members run faith-based, secular, and every other kind of program, and what counts as a childcare issue differs among them. The Forum works because no member has to defend where their program draws that line.
• Protect privacy. Do not post names, photos, screenshots, or any other information that could identify a child, family, staff member, or other individual, whether directly or by context. Every member of the Forum can read every Submission.
• Keep urgent and legal matters out of the Forum. Do not use the Forum to handle an active investigation, a licensing complaint, a legal dispute, suspected abuse or neglect, or any emergency. Take these to your licensing agency, attorney, insurance carrier, or the appropriate reporting authority. Posting in the Forum does not satisfy any mandated reporting or other legal obligation you may have.
• Share, don’t sell. Do not advertise, promote, solicit, or fundraise, including for your own business, products, or services. You may share a link to a resource in which you have no financial or business interest.
• Only share what is yours to share. Do not post material you do not own or have permission to share, including franchise curricula, a current or former employer’s handbooks or policies, licensed tools or materials, or anything covered by a confidentiality or nondisclosure obligation. By posting, you represent that you have the right to share your Submission and to grant the license described in these Terms.
• Treat member posts as experience, not advice. Submissions reflect each member’s own program, state, and experience. Director Zen does not verify or endorse them, and they are not legal, regulatory, or other professional advice. Check any idea against your own policies, your licensing rules, and the professionals you rely on before acting on it.

Moderation and reporting. Director Zen does not pre-screen Submissions and does not monitor the Forum at all times. If you see a Submission that violates these Terms or concerns you, email support@directorzen.com. Director Zen may, at its sole discretion and without notice, remove or edit any Submission, and may suspend or end your access to the Forum or the Website if you violate these Terms or the Community Guidelines, including through repeated violations.

You agree that any content you submit to the Forum (including but not limited to comments, forum messages, video, audio, or photographs, each a "Submission") may be removed, modified, edited, published, displayed or republished by Director Zen. You agree to waive anyrights you may have otherwise had to not have your Submissions altered or changed.

You acknowledge and agree that Director Zen is an interactive computer service provider under Section 230 of the Communications Decency Act. Though Director Zen may edit, remove, or control any Submission and other content displayed through the Forum, you agree that Director Zen will not be considered an information content provider and will not be held liable for the republication of defamatory or tortious content created by you or third parties, whether through the Forum or otherwise.

You agree to grant Director Zen a nonexclusive, perpetual, world-wide, royalty free, sub-licensable license to Submissions you make to the Website, including without limitation the right for Director Zen or any third party designated by Director Zen to use, publish, publicly display, copy, transmit, excerpt, modify or create derivative works from, host, index, tag, cache, encode, adapt to different platforms (in any media form known or later developed) any Submission posted by you to the Website.

Director Zen may use the ideas, themes, and general subject matter of Submissions to create additional content, and may describe in general, non-identifying terms the challenges members raise.

Notwithstanding this license, Director Zen will not publish, quote, screenshot, or otherwise reproduce your Submission outside the Forum, or identify you or your program by name or by context, without your express, prior consent. Nothing in this paragraph limits Director Zen’s right to edit, moderate, or remove Submissions within the Forum.

Use of Website

You agree not to use the Website to develop or train a machine learning or artificial intelligence (AI) system such as a large language model. You agree not to use Website Content to develop any software programs, models, or algorithms.

Upon registering and creating an account with Director Zen, you create login credentials by providing an email address and choosing a password. Each registration is for one user. You may not share your login credentials with anyone else. You are solely responsible for keeping your password confidential.

Please notify Director Zen of any unauthorized use of your account.

To use the Website, you must be 18 years of age orolder.

Representation

Director Zen does not endorse the accuracy or reliability of any advice, statement, opinion, or other information uploaded ordistributed through the Website by any user, information provider, or any other person. You agree that any reliance upon opinions, advice, statements, orinformation posted by users of the Website shall be at your own sole risk.

Director Zen strives to provide accurate and up-to-date information. However, we are not responsible for:

Governing Law & Jurisdiction

These Terms, and all claims or causes of action (whether in contract, tort, or statute) that may be based upon, arise out of, or relate to these Terms and your use of the Website shall be interpreted, construed, and enforced pursuant to the internal laws of the State of California, including its statute of limitations, without regard to its conflicts of laws provisions, any borrowing statute, or the conflicts of laws provisions of any other state or country. You agree to submit any dispute arising out of, referring, or relating to the Website, Content, or these Terms to the sole and exclusive jurisdiction of the State of California.  To the greatest extent permitted by law, anyaction on these Terms and any action relating to your use of the Website shall be brought and maintained solely in San Diego County, California.  The parties hereby waive any right, by statute or otherwise, to seek to change the venue with respect to any claim arising from or relating to your use of the Website, whether based on a claim that another venue would be more convenient for the parties, witnesses, the court, or based on any other legal theory. To the extent a claim qualifies under for adjudication in small claims court, any action shall be brought in front of the Small Claims Courts of San Diego County, in the State of California. For any claims not subject to resolution under small claims court, you agree to submit such claims to binding arbitration under the JAMS Arbitration Rules by a neutral arbitrator in San Diego County.
